CharterUp – Upgrading fundamental rights know-how for Luxembourg

Implementation

The project is being implemented by EIPA Luxembourg – European Centre for Judges and Lawyers (ECJL) in partnership with Passerell in Luxembourg.

Introduction

CHARTER UP will strengthen the knowledge and ability of Civil Society Organisations (CSO), rights defenders and legal professionals, to effectively engage in litigation practices at national and EU level and to improve access to justice and enforcement of rights under the EU Charter of Fundamental Rights (Charter).

 

The project will provide training for at least 225 beneficiaries and provide additional resources.

CHARTER UP relies on training, knowledge sharing and exchange of experience and good practices to strengthen the knowledge and know-how of civil society organisations (CSOs), legal practitioners and independent human rights bodies (NHRIs) in Luxembourg on remedies for protecting rights under EU law, especially the EU Charter of Fundamental Rights (Charter), and how to design litigation strategies to make use of those remedies. The training component of the project along with the Charter Checklist, the quarterly Charter newsletter, and the Charter case law database will provide practitioners with up-to-date and ready-to-use information on the Charter and the means of relying on it, and this will be complemented with the Charter Checkpoint and the Roundtables providing additional opportunities, spaces and channels to discuss and exchange on those matters. This will allow to systematise and professionalise the handling of Charter-relevant cases within the Luxembourgish legal system.

The project is based on a thorough analysis of the needs of the Fundamental Rights ecosystem in Luxembourg, allowing several categories of key fundamental rights actors to access and use information on how to strategically rely on the Charter of Fundamental Rights. The activities are focused on Luxembourg and designed to fit with the legal culture of local practitioners and assist them in developing and sharing good practices and boosting their confidence and skills in engaging in EU law litigation practices, especially based on the Charter of Fundamental Rights.

More specifically the proposed project seeks to provide targeted training activities and support for:

  • legal practitioners
  • lawyers working in NRHIs and rights-defending institutions
  • civil society organisations (CSOs) of Luxembourg.

Analytical resources details

The training activities of CHARTER UP, the analytical resources, and the opportunities to share experiences (round-table events) will help participants enhance their knowledge and know-how and contribute to designing and implementing litigation strategies in cases concerning the Charter.

Training activities details

All training activities will be conducted in French and will discuss the subject matter in an EU fundamental rights context directly referring to the EU Charter, its relationship with domestic law, and where applicable, its relationship and synergies with the European Convention of Human Rights and the related practice of the European Court of Human Rights.
